Organized by: ICRC-IHL department with Coordination of GIHE peace center

Targeted audience were: Law and Political students of GIHE and other Private universities

Numbers of Participants were:  80 Male and Female   

 

Background information:

Organizing academic seminars, dialogues and conferences are the GIHE Peace Center main objectives also academic circles alongside with other target audience are one of the impotent target audiences for the ICRC in general and specifically for IHL and Communication Department.

 

Speakers during the opening were:

– Professor Hamid Layan GIHE Vice Chancellor in Academic Affair

– Jean Jerome ICRC Deputy Head of Delegation

 

Speakers during closing were:

– Mr. Mohammad Hussin Zahid Legal Adviser Ministry of Defense

 

Lecturers were:

– Mr. Abass Azimi, Peace Centre Manager, IHL professor GIHE and 30th SATS alumni

– Mr. Mukhtar Hussian Haidari, IHL professor and Senior Researcher at Afghanistan Independent Human Rights Commission

– Mirwis Noori. COM officer – ICRC /AFC

– Ezat Gul Legal Adviser ICRC Kabul

– Yar Mohammad Yari legal adviser ICRC Kabul

– Enforcement of IHL (Mr. Mukhtar Haidari)

– The role of the ICRC in promotion of IHL (Yari)

Discussion:

As scheduled, the program opened with the welcome address by professor Hamid Layan, he thanked from the ICRC and mentioned briefly the ICRC history and its humanitarian activities in Afghanistan and he mentioned that the GIHE has the honor for hosting such session and he reminded that the GIHE is one of the private universities that teaching IHL for LLB students.   He encouraged the participants to ask all related questions.

After that Mr.Jean Jerome Deputy Head of Delegation welcomed all the participants and thanked from the GIHE vice chancellor for hosting such session. He added that academic society is very important for the ICRC and from our view they are the future leaders.

The ICRC  alongside of other humanitarian activities in Afghanistan  have the honor to providing technical support for universities for IHL integration in the university curriculums, organizing IHL workshop and training for the Law and Political Science professors and students in the country levels. For example in the month of November one the professors from GIHE participated in IHL training session in Lahor Pakistan and also we organized two IHL session in Herat for students of Law and political science of Ghalib university and Heat University. I hope that session address all your questions about the ICRC and IHL.

 

The last part of the seminar was the closing speech by Mr. Zahid Legal Adviser in Ministry of Defense, he thanked from the GIHE, ICRC and Participants and mentioned that the seminar was very useful at all and the topics which were discussed in overall was related to each other’s and we will ask the ICRC to organized such a session for staff of the Legal directorate of MoD as well.

 

Main questions raised by the participants:

  1. Can you elaborate more about the distinction principle of IHL in armed conflict?
  2. You have said there are 25 cases in ICC which is under review can you name some of them or can you name them based on region?
  3. What are the derogation rights under IHRL as compare to IHL?
  4. What is the role of IHL in counterterrorism attacks?
  5. Is IHL not in contradiction to Islamic Law if not how?
  6. What is the role of ICRC in enhancement o IHL and how they are working with university student in Afghanistan?
  7. We respect the IHL but if the other hostile group in respect to terrorist organizations are not respecting, don you think it bound and limit military operation, if yes why should we only respect IHL in our military operations?
  8. If ICRC is receiving its major funds from states how can it ensure impartiality, neutrality and independence principles?

Conclusion:

The conference was an exceptional opportunity for promoting the knowledge of the respective Gawharshad students about the ICRC and IHL related issues. According to the feedback from the participants the seminar was assessed as a constructive and useful program while they requested the ICRC to continue such programs.

It is said by ICRC that as mentioned this target audience of law students will become the future decision makers, legal advisers, lawyers or lectures therefore, the IHL department intends to continue these kinds of seminars and conferences for the professors of the law faculties.
